Disability Lawyers Discuss Aetna’s Attempt to Avoid Payment of Claims to Amazon Workers
In this video disability insurance lawyers Gregory Dell and Cesar Gavidia discuss the recent Hartford purchase of the Aetna Disability Insurance Company and what impact that may have on Amazon employees who file claims for long-term disability. They conclude that the claims review process will likely not change since both companies already do everything they can to avoid paying a claim.
Thousands of Amazon employees who are disabled from working in their warehouse or distribution center jobs are awarded long term disability since they can no longer work in their own occupation, which requires light, medium or heavy duty work. After 24 months, the disability definition changes and they can only continue receiving benefits if they are unable to work in any gainful occupation for which they may be qualified to perform based on their education, training and experience.
Aetna often decides workers have transferable skills and can work in sedentary jobs like customer service or some type of computer work. The insurance company ignores the fact that these jobs still require tasks such as brain power and mental concentration that an injured person may not be able to perform.
We work with claimants and their doctors in anticipation of the definition change. Medical experts generally agree that someone who is disabled from working in a medium level job is likely to also be unable to work in a sedentary job.
